After nearly 30 years of maintaining his innocence, Bernard Doyle has been exonerated in the tragic case involving the death of his partner’s toddler. Ontario’s Court of Appeal overturned Doyle’s manslaughter conviction on Monday, bringing an end to a long and arduous legal battle.

However, a crucial aspect of Doyle’s conviction rested on the testimony of pathologist Charles Smith, who was later discredited and had his medical license revoked in 2011. The court found that Smith’s “misguided testimonies on child deaths sent several innocent people to jail,” highlighting the significant role his unreliable expert evidence played in Doyle’s wrongful conviction.

In its decision to acquit Doyle, the Court of Appeal acknowledged that his case was yet another example of a wrongful conviction tainted by the unreliable testimony of the disgraced pathologist.
